This Privacy Policy describes how we collect, use, store, and disclose Personal Information when you use our website and our AI Agent Fleet services (the “Services”).

This Policy applies to the Personal Information collected by amplAIfy. “Personal Information” is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

B2B Context and Data Roles: Our Services are designed for business use. How we handle Personal Information depends on the context:

  • amplAIfy as Data Controller: We act as a Data Controller when we collect information for our own business purposes, such as managing customer accounts, billing, providing support, and conducting marketing activities.
  • amplAIfy as Data Processor: When our Customers use our Services, they may input data which can include Personal Information (e.g., candidate details) (“Customer Data”). In this context, the Customer is the Data Controller, responsible for ensuring they have the necessary consents and legal basis to input this information. amplAIfy is the Data Processor, processing this information solely on behalf of the Customer to provide the Services.

If your Personal Information has been included in Customer Data (e.g., you are a job candidate), you should contact the relevant Customer (the organization using our Services) directly to exercise your privacy rights.

2. What Personal Information We Collect

2.1. Information We Collect as a Controller:

  • Account and Contact Information: Name, job title, company name, email address, and phone number of Authorized Users and customer representatives, as provided by your identity provider (e.g., Google or Microsoft).
  • Billing Information: Billing details required to process payments.
  • Communications: Records of your interactions with us (e.g., support requests, emails).
  • Usage and Technical Data: Information collected automatically when you use our website or Services, including IP addresses, browser type, access times, device information, and usage metrics.

2.2. Information We Process as a Processor (Customer Data):

Our Customers and their Authorized Users input data into the Services during a session. This may include:

  • User Queries: The prompts and queries submitted by Authorized Users.
  • Uploaded Data: Any files, documents, or text (such as recruitment data, candidate profiles, or resumes) explicitly uploaded or attached by an Authorized User into the chat interface during a session.

3. How We Use Personal Information

We collect and use Personal Information for the following purposes:

  • To Provide the Services: To operate, maintain, and provide the features of the Services, including processing Customer Data as instructed by the Customer.
  • Account Management: To manage user accounts, provide customer support, and process billing.
  • Communication: To send administrative information, updates, and security notices.
  • Service Improvement: To analyze usage trends and improve the functionality and user experience of the Services (using aggregated or de-identified data where possible).
  • Marketing: To send promotional communications (you may opt-out of marketing communications at any time).
  • Legal Compliance: To comply with applicable laws and regulations.

4. Disclosure of Personal Information

We do not sell your Personal Information. We may disclose Personal Information in the following circumstances:

  • Service Providers (Subprocessors): We engage third-party companies to facilitate our Services. Our primary infrastructure provider is Google Cloud Platform (GCP). We may also use providers for billing and customer support. These providers are contractually obligated to protect the information and use it only for the purposes for which it was disclosed.
  • Compliance with Laws: We may disclose information if required by law, regulation, or legal process (such as a court order or subpoena).
  • Business Transfers: Information may be disclosed or transferred as part of any merger, acquisition, or sale of company assets.
  • With Your Consent: We may disclose information for other purposes with your consent.

5. Use of Artificial Intelligence (AI)

The Services utilize Artificial Intelligence (AI), specifically Google’s generative AI models hosted on GCP, to process Customer Data and generate outputs.

  • Data Processing: AI is used to analyze inputs and generate reports, strategies, and other outputs based on our proprietary methodologies and the user’s instructions.
  • No Training on Customer Data: Consistent with Google Cloud’s enterprise data privacy commitments, the Customer Data you input into the Services is not used by Google to train their foundational AI models.

6. Data Security and Storage

6.1. Security Measures. We implement appropriate technical and organizational measures to protect Personal Information against unauthorized access, alteration, disclosure, or destruction. We leverage the robust security infrastructure provided by Google Cloud Platform, including encryption of data at rest and in transit.

6.2. Project-per-Customer Architecture. We utilize a “Project-per-Customer” deployment model. This means each Customer’s Service environment and Customer Data are logically isolated within a dedicated GCP project, significantly enhancing data security and minimizing the risk of cross-customer data exposure.

7. Data Retention

We retain Personal Information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, including for the duration of the Customer’s subscription, and as required to comply with our legal obligations, resolve disputes, and enforce our agreements. Upon termination of a customer agreement, the dedicated Customer Project is decommissioned, and the Customer Data contained within it is securely deleted according to our policies.

8. Cross-Border Data Transfers

amplAIfy is based in Australia. Our Services are hosted on Google Cloud Platform, which operates a global infrastructure.

  • Data Residency: We offer Customers the ability to select the GCP region where their Customer Project is deployed (e.g., Australia), allowing them to meet data residency requirements.
  • Transfers: If Personal Information is transferred outside of Australia (e.g., for support purposes or by utilizing global service providers), we take reasonable steps to ensure that the overseas recipient handles the information in accordance with the APPs or is subject to a law or binding scheme that has substantially similar protections.

9. Your Privacy Rights and Choices

In accordance with the Australian Privacy Principles, you have the following rights:

  • Access (APP 12): You have the right to request access to the Personal Information we hold about you.
  • Correction (APP 13): You have the right to request correction of any Personal Information that is inaccurate, incomplete, or out-of-date.
  • Opt-Out: You may opt-out of receiving marketing communications from us.

To exercise these rights regarding information where amplAIfy is the controller, please contact us using the details below. If your request relates to Customer Data where amplAIfy is the processor, we will direct you to contact the relevant Customer (the data controller).

10. Complaints

If you believe we have breached the Australian Privacy Principles, please contact us using the details below. We take privacy complaints seriously and will respond within a reasonable timeframe.

If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC).

11. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on our website and updating the “Last Updated” date.
